Terms of Service

These Terms of Service ("Terms") govern your access to and use of TextTiger AI's website, platform, and services (collectively, the "Service") operated by TextTiger AI ("we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms.

1. Service Description

TextTiger AI provides an AI-powered SMS and voice lead qualification platform. The Service includes:

• Dedicated AI phone numbers that handle inbound calls and text messages
• AI-powered voice receptionist for answering and qualifying phone calls
• Automated SMS conversations for lead intake and qualification
• Lead management dashboard with analytics, transcripts, and conversation logs
• Appointment booking and notification features
• Integration with third-party services (Twilio, OpenAI, Stripe)

2. Account Registration

To use the Service, you must:

• Create an account using Google OAuth
• Be at least 18 years of age
• Provide accurate and complete information
• Be authorized to act on behalf of any business you register

You are responsible for maintaining the security of your account and for all activities that occur under your account. Notify us immediately at support@texttigerai.com if you suspect unauthorized access.

3. Subscriptions and Payment

3.1 Plans and Pricing

The Service is offered on a subscription basis with the following tiers:

• Starter ($99/mo): 1 AI phone number, 100 leads/month, SMS + voice
• Professional ($249/mo): 3 AI phone numbers, 500 leads/month, CRM integration
• Enterprise ($499/mo): Unlimited numbers and leads, white-label options, API access

Prices are subject to change with 30 days' notice. Usage beyond plan limits may result in temporary service restrictions or overage charges.

3.2 Billing

Subscriptions are billed monthly in advance via Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis. Failed payments may result in service suspension after a 7-day grace period.

3.3 Cancellation

You may cancel your subscription at any time through the billing portal. Cancellations take effect at the end of the current billing period. No prorated refunds are provided for partial months. Upon cancellation, your AI phone number(s) will be released.

4. Acceptable Use

You agree to use the Service in compliance with all applicable laws and our Acceptable Use Policy. Specifically, you must not:

• Use the Service for unsolicited bulk messaging (spam)
• Send messages without proper consent under the TCPA, CAN-SPAM Act, or equivalent laws
• Use the Service for illegal, fraudulent, or deceptive purposes
• Attempt to circumvent usage limits, authentication, or security measures
• Resell, sublicense, or redistribute the Service without written authorization
• Transmit malware, viruses, or harmful code
• Harass, threaten, or abuse any person through the Service

We reserve the right to suspend or terminate accounts that violate these terms without notice.

5. Telecommunications Compliance

5.1 TCPA

You are solely responsible for compliance with the Telephone Consumer Protection Act (TCPA) and all state telecommunications laws. TextTiger AI facilitates inbound-initiated conversations — leads contact you first by texting or calling your AI number. You must:

• Not use the Service for outbound cold calling or unsolicited texting
• Honor opt-out requests promptly (TextTiger AI automatically processes STOP messages)
• Maintain records of consent where required
• Include proper identification in messages as required by law

5.2 A2P 10DLC

Our SMS service operates in compliance with carrier A2P 10DLC requirements. We register campaigns with The Campaign Registry (TCR) as required. You agree to provide accurate business information for registration purposes.

6. Data and Privacy

Your use of the Service is subject to our Privacy Policy. You acknowledge that:

• Lead data (phone numbers, messages, call recordings) is stored on our servers and those of our service providers
• Message content is processed by OpenAI's API for AI response generation
• Call audio is processed and stored by Twilio
• You are a data controller for your leads' personal information; we act as a data processor

You are responsible for providing appropriate privacy disclosures to your leads regarding the use of AI and data processing.

7. Intellectual Property

The TextTiger AI platform, including its design, code, branding, and AI models, is owned by TextTiger AI. You retain ownership of your business data and lead information. You grant us a limited license to process your data solely to provide the Service.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We do not guarantee that:

• The Service will be uninterrupted or error-free
• AI responses will be accurate, appropriate, or legally compliant in all situations
• SMS messages or calls will be delivered successfully in every case
• The Service will generate any specific number of leads or conversions

You acknowledge that AI-generated responses may occasionally produce incorrect or inappropriate content. You should monitor conversations and have human oversight of your lead qualification process.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TEXTTIGER AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST DATA, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF THE SERVICE.

Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless TextTiger AI, its officers, employees, and partners from any claims, damages, losses, or expenses (including attorney's fees) arising from:

• Your use of the Service
• Your violation of these Terms or applicable laws
• Your violation of any third party's rights, including TCPA violations
• Content transmitted through your account

11. Termination

We may suspend or terminate your account at any time for violation of these Terms, non-payment, or at our sole discretion with 30 days' notice. Upon termination:

• Your access to the Service will cease immediately
• Your AI phone number(s) will be released
• You may request an export of your data within 30 days of termination
• After 30 days, your data will be permanently deleted

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration administered by the American Arbitration Association, except where injunctive relief is sought.

13. Changes to These Terms

We may modify these Terms at any time. Material changes will be communicated via email or a prominent notice on our website at least 30 days before taking effect. Continued use of the Service after changes constitutes acceptance.
